Terms
The term "Relax in France" relates to the owners of the Relax in France website, www.relaxinfranceonline.com, and will hereafter be referred to as the company.

The term "the client" relates to potential holidaymakers who access the website in search of holiday property for rental.

The term "the owner" relates to the owners of holiday property which is advertised on the website. The owner may be a private individual or individuals, or a company which places advertisements on behalf of a private individual or individuals.


Conditions

The company exists to advertise holiday property for rental on behalf of the owners. The company will not accept responsibility for availability errors made by the owners, or for booking errors made by either the owner or the client.

Although every effort will be made by the company to ensure that the details of property or properties supplied by the owners are correct, the company will not assume responsibility for any omissions or errors relating to any text or photograph used in any published advertisement on the company's website.

It is the responsibility of the owner to check the details of his or her advertisement(s), and to advise the company as soon as possible of any omissions or errors. Minor alterations to the advertisement will be carried out free of charge. The company reserves the right to levy a charge for major alterations to an advertisement.

Rental prices and all details relating to the owner's property or properties will be published on the company's website in good faith. The company will not accept responsibility for changes in price or details made by the owner.
In the unlikely event of a dispute arising between the client and the owner, the company will not accept responsibility for intervening in such a dispute.

The company reserves the right to determine the design layout of the website, including the right to edit text, or amend layouts or photographs supplied by the owners. The company cannot be held responsible for any loss, or damage, resulting from the design, or positioning, of the properties, or any changes made to text or photographs supplied by the owners.

Details of properties will be placed, on behalf of the owners, on the company's website for a period of one year following the publication on the website of the owner's property or properties. The owners will be notified in writing or by email shortly before the yearly period of advertising is due to expire. At the end of the period of one year, properties will be removed from the website unless a further year's advertising is agreed between the company and the owner, at a fee to be decided by the company.

The fee of £85.00* per year will be the price of one year's advertising for each property webpage. Where the owner has more than one property webpage advertised on the site, a reduction is given for each subsequent property webpage.

*The fee for the advertisement of all properties may be changed at any time at the company's discretion.

All advertisements are prepaid.

Payment can be made by credit card online using the RBSWorldPay system either in pounds sterling or Euros or by cheque either in pounds sterling or Euros made payable to Relax in France, 1 Chemin des Vignes, Le Tinal D'Abrens, Caunes Minervois, 11160 France.

As soon as your payment is received, either via RBSWorldpay or by cheque, your advertisement can or will be created and uploaded onto our website. We will then send a confirmation email and give you a property reference number. At this stage we will ask if you would like to make any changes to your advertisement. We attempt to make all changes the same day and they are free of charge.

The company provides an advertising service, it does not sell goods or products. A refund can be given at the discretion of the company if within five days, following the initial uploading of an owners property webpage advert the said owners request the cancellation of the advert by email to info@relaxinfranceonline.com. The company will give a refund less £20 or 30 euros for work undertaken in advertisement creation and less £10 for administration fees.

All photographs and other material supplied by the owner to the company will remain the property of the owner.

It is the responsibility of the owner to ensure that no photographs, text or other material supplied to the company are in breach of copyright laws.

A link to the individual property owner's home website can be included in the advertisement at the owner's request. The company takes no responsibility for any text or photographs appearing on the owner's home website. The company reserves the right to remove links from adverts to external or home websites which are not appropriate to the interests of the company and its owners.

The company treats any personal information with respect and confidentiality and takes all reasonable steps to ensure personal details are stored securely. Personal information will not be provided to third parties for any marketing or promotional use.

If the company receives substantiated complaints from any number of site users about a specific property webpage misrepresenting the property, its surroundings, price, etc. then the company reserves the right to remove the specific property webpage for which no refunds will be given. If an owner wishes to have their property webpage removed from the website before the end of their advertising period this will be done following formal notice by the owner by email to the company. No refunds will be given.

The owner shall indemnify the company against any loss or damage suffered by the company, including negotiated settlements, civil court judgments, arbitrated settlements and any other fees which may result from claims on the company by third parties relating to breaches of copyright, breach of trademark, illustration, photograph or logo supplied by the owner to the company.

In the event that the company is notified by a third party of an apparent or perceived breach of copyright concerning texts, photographs, logo or any other material supplied by the owner, the company reserves the right to remove any offending material from the website, after written notification to the owner.

All pages on the website remain the property of the company. Pages which appear may be printed for the personal use of the client or the owner, but may not be reproduced in any form, mechanical, electronic or otherwise, for use on any public advertising space, whether such space may be a media publication of any nature, or an electronic publication of any nature, including the internet. All such reproductions will be deemed to be in breach of copyright.

The company will not be liable for any loss or damage suffered by the owner, the client or third party associated with the owner or the client, which arises from non appearance of the owner's advertisement on the which results from unreliability or inefficiency on the part of the website's service provider, either in failure to initiate or sustain public access to the web pages supplied by the company, or from any other factors, natural, mechanical or electronic, which are beyond the company's control.
